In the name of God Amen I Robert Whitney of Cool in the County of Chester gent. doe make my last will and testament in manner following. Imprimis I give and devise all my mannours, messuages, lands and premises with their rights members and appurten(an)ces unto my Son Hugh Whitney To hold to him and his heirs for ever Item I give and bequeath the sum of one hundred pounds apiece to my Children Katherine Whitney, Robert Whitney, Ann Whitney, Thomas Whitney, Margaret Whitney, Peter Whitney, Mary Whitney, Jeffery Whitney, John Whitney and William Whitney to be paid to them respectively as they shall attaine the age of one & twenty years or be marryed which shall first happen : and if one or more of them dye before their legacy becomes due my will is that the share of those dyeing shall be equally divided amongst the survivours, and my will is that my younger children afore menc(i)oned shall receive interest for their legacyes till they become due. Item I give to my daughter Dorothy Atcherley one shilling Item I give to my son Hugh all my personal estate and lastly doe appoint my said son Hugh Whitney and my wife Dorothy Whitney Executors of this my will In Witness whereof I have hereunto put my hand and Seale this third day of February in the year of our Lord one thousand Seven hundred and twenty six

Hugh Whitney the above named Executor being dead and Dorothy Whitney the Executrix above named having under her hand and Seal in writing renounced, Thomas Cradock Gent: (pursuant to a Decree of Court) was Juror in Common form as Administrator with this will annexed.

To all whom those presents shall come Dorothy Whitney of Wrenbury in the County of Chester widow and Relict of Robert Whitney late of Cool in the said County of Chester Gentleman Deceased sendeth greeting Whereas the said Robert Whitney Did duly make and publish his last will and Testament in writing bearing the date the third day of February which was in the year of our Lord one thousand seven hundred and twenty six and thereof Did Appoint his the said Testators Son Hugh Whitney and the said Dorothy Executors as in and by the same referrences being thereunto had may appear And Whereas the said Hugh Whitney solely took upon himself the burthen of the said Executorship (but is since dead) And the said Dorothy Whitney never acted therein or intermeddled with the effects of the said Testator remaining in this Diocess Now Know the that the said Dorothy Whitney for divers good Causes and Considerations her hereunto moving Hath renounced and refused and by these presents Doth renounce and refuse to prove the said will of the said Decedent in the Consistory Court of the Diocess of Chester or anywise to Intermeddle in Administration of the Goods rights or Credits of the said Decedent Robert Whitney remaining in the Diocess of Chester as Executor or otherwise And she the said Dorothy Whitney Doth hereby give her full and free Consent Authority and power as much as in her lyes And doth desire that Administration with the will Annexed of all and Singular the Goods Rights and Credits of the said Decedent Robert Whitney remaining in the said Diocess may be granted and Committed to Thomas Cradock of Nantwich in the said County of Chester Gentleman In Witness whereof the said Dorothy Whitney hath hereunto set her hand and seal the fifteenth day of March in the year of our Lord One thousand seven hundred and forty nine.
