2. Robert Whitney, esq.,
FEOFFMENT of the manor of Whitney, the advowson of the church of St. Peter of Whitney, together with lands and tenements in Whitney, Stowe and Millehalgh, to the use of the said R.W. and his heirs male, and in the event of his death without heirs male, to the use of the said R.W. and his heirs by his first wife, Constance, daughter of Sir James Andeley, lord of Andeley, and in the event of the lack of such heirs, to the right heirs of the said R.W.

1. Sciant presentes et futuri quod nos Simon Milborne armiger, Rogerus Vaghan de Clero armiger, Walterus Bollehedde rector ecclesie de Wynfreton /

Let all present and future men know that we Simon Milborne esquire Roger Vaughan of Clero (Clyro) esquire Walter Bollehedde rector of the church of Wynfreton

2. Walterus Mille vicarius de Kyngton & Johannes Taillour vicarius de Almaly tradidimus feoffavimus liberavimus & hac presente carta nostra tripartita /

Walter Mille vicar of Kyngton (Kington) & John Taillour vicar of Almaly (Almeley) have let, enfeoffed and by this our present tripartite charter /

3. indentaturam confirmavimus Roberto Whitney armigero manerium sive dominium nostrum de Whitney [?? et] advocationem sive patronatum ecclesie Sancti Petri de /

indenture confirmed to Robert Whitney esquire our manor or lordship of Whitney (and) the advowson or patronage of the church of St. Peter of

4. Whitney cum omnibus & singulis pertinentiis suis regalitatibus franchesis consuetis & appendentis suis quibuscumque dicto manerio sive dominio qualitercumque /

Whitney with all and singular its customary and attaching appurtenances regalities franchises whatsoever in the said manor or lordship by whatever right /

5. spectantibus tradidimus etiam feoffavimus & liberavimus per presentes prefato Roberto Whitney [ ??] terras & tenementa nostra prata, pascuas, pasturas/ /

belonging, we have given and enfeoffed and delivered by (these) presents to the aforesaid Robert Whitney [???] our lands and tenements meadows, grazing, pastures

6. molendina boscos vasta redditus reversiones & servicia cum pertinentiis suis in Whitney Stowe & Millehalghe habendum & tenendum omnia superdictum manerium /

mills woods wastes rents reversions and services with their appurtenances in Whitney, Stowe and Millehalghe (Millhalf) to have and to hold all the abovesaid manor

7. sive dominium advocationem sive patronatum ecclesie predicte cum omnibus & singulis pertinentiis suis regalitatibus franchesis consuetis & appendentis suis quibuscumque /

or lordship advowson or patronage of the aforesaid church with all and singular their customary and attached appurtenances regalities franchises whatsoever

8. dicto manerio sive dominio qualitercumque s(e)pectantis acetiam omnia predictas terras & tenementa prata pascuas pasturas molendina boscos vasta, redditus, reversiones /

in the said manor or lordship by whatever right belonging and all the aforesaid lands and tenements meadows grazing pastures mills woods wastes, rents, reversions

9. & servicia cum pertinentiis suis in Whitney Stowe & Millehalgh predictis supradicto Roberto Whitney & heredibus masculinis de corpore sua legitime procreatis /

and services with their appurtenances in Whitney, Stowe and Millehalgh aforesaid to the abovesaid Robert Whitney and the male heirs of his body lawfully begotten

10. imperpetuum de capitalibus dominis feodi illius pro servicia inde prius debitis & consuetis Et si contingat dictum Robertum Whitney sine herede masculino de corpore /

for ever of the chief lords of that fee for services thereof formerly owed and customary And if it should happen that the said Robert Whitney, without a male heir of his body

11. suo procreato obire quod absit tunc volumus & concedimus per presentes quod dictum manerium sive dominium advocatio sive patronatum ecclesie predicte cum /

begotten, should die, then we wish and grant by these presents that the said manor or lordship advowson or patronage of the aforesaid church with

12. omnibus & singulis pertinentiis suis regalitatibus franchesis consuetis & appendentis suis quibuscumque dicto manerio sive dominio qualitercumque spectantis /

all and singular its appurtenances regalities franchises whatsoever customary and attaching to the said manor or lordship by whatever right belonging

13. acetiam omnia predictas terras tenementa prata pascuas pasturas molendina boscos vasta redditus reversiones & servicia cum pertinentiis [?? suis in Whitney, Stowe] /

and all the aforesaid lands tenements meadows grazing pastures mills woods wastes rents reversions and services with [their] appurtenances in Whitney, Stowe

14. & Millehalgh predictis remaneant dicto Roberto Whitney & heredibus suis per ipsum de corpore Custancie quondam sue prime uxoris filie /

and Millehalgh aforesaid shall remain to the said Robert Whitney and his heirs by himself and the body of Custance (Constance) formerly his first wife daughter

15. Jacobi Audeley militis domini Audeley legitime procreatis imperpetuum tenendum de capitalibus dominis feodi illius pro servicia inde prius debita et consueta Et si /

of James Audeley, knight, lord Audeley, lawfully begotten, for ever to hold of the chief lords of that fee for services thereof formerly owed and customary; And if

16. contingat dictum Robertum Whitney sine herede per ipsum de corpore dicte Custancie procreate obire tunc volumus & finaliter concedimus quod dictis

it should happen that the said Robert Whitney should die without an heir begotten of himself and the body of the said Custance then we wish and finally grant

17. manerium sive dominium advocationem sive patronatum ecclesie predicte cum omnibus & singulis pertinentiis suis regalitatibus franchesiis consuetis et appendentis /

the manor or lordship advowson or patronage of the aforesaid church with all and singular its appurtenances regalities [their] franchises accustomed and attaching

18. suis quibuscumque dicto manerio sive dominio qualitercumque spectantibus acetiam omnia predicta terras & tenementa prata pascuas pasturas molendina boscos /

whatsoever to the said manor or lordship by whatever right belonging and all the aforesaid lands and tenements meadows grazing pastures mills woods

19. vasta redditus reversiones & servicia cum pertinentiis suis in Whitney Stowe & Millehalghe predictis remaneant rectis heredibus dicti Roberti Whitney /

wastes rents reversions and services with their appurtenances in Whitney, Stowe and Millehalghe aforesaid shall remain to the right heirs of the said Robert Whitney

20. de capitalibus dominis feodi illius pro serviciis inde prius debitis & consuetis In cuius rei testimonium huic presenti carte nostre tripartite indentate sigilla /

of the chief lords of that fee for services thereof formerly owed and customary; In witness thereof we have affixed our seals to our present indented tripartite charter
